These Terms of Use ("Terms") govern your use of KinStatus, a family check-in and reassurance service operated by Desimir Abadzhiev (Десимир Абаджиев), a natural person established in the Republic of Bulgaria ("we", "us", "our") — see our Legal Notice for full operator details. By creating an account or accepting an invitation, you agree to these Terms. Use of KinStatus, including by a protected person who activates it on their phone, is also subject to these Terms. Please also read our Privacy Policy, which explains how we process personal data — it is a notice about our data practices, not a contract you are asked to accept.
1. What KinStatus is, and what it is not
KinStatus helps families who care for a loved one from a distance know when that person says they are OK, wants a call, or needs help. Status — the check-in itself — is the core purpose of KinStatus; last known location is optional, supporting context.
KinStatus is not an emergency, medical, care, or rescue service, not a continuous-monitoring or security service, and it does not guarantee that any person is safe. Status, location, battery, last-activity information, reminders, and alerts may be delayed, unavailable, inaccurate, incomplete, or not delivered. A missed or delayed check-in does not by itself mean something is wrong. In an emergency, call 112 or your local emergency number — do not rely on KinStatus.
2. Eligibility and adult-only use
KinStatus is for use by adults aged 18 and over, both as caregiver account holders and as protected persons. It is not directed at children, and you must not use KinStatus to monitor a child or any person who lacks the legal capacity to agree to it, unless you have legal authority to act in that person's interest. A family relationship by itself does not create that authority.
3. Roles in KinStatus
- Caregiver account holder — anyone who creates a KinStatus account.
- Family owner — the caregiver who creates a family group and manages its membership, including inviting and removing helpers.
- Invited caregiver or helper — someone added to a family group by its owner, with access determined by their role.
- Protected person — the person being cared for, who is invited by a caregiver and who activates KinStatus on their own phone. Once activated, the protected person is a user of KinStatus in their own right, and their use of KinStatus is subject to these Terms.
4. Invitations and authority
A caregiver may invite a protected person to use KinStatus. By sending an invitation, the caregiver represents that they have a lawful basis and, where required, the agreement of the protected person (or of someone with legal authority to act in that person's interest) to do so. A family role, by itself, does not prove legal authority, guardianship, or consent to monitor another person.
5. Transparent, lawful use — no secret monitoring
KinStatus must be used transparently and lawfully. You must not use KinStatus to monitor, track, or disclose information about another person secretly, without their knowledge, or without a lawful basis and any agreement their own participation requires. A protected person should know that KinStatus is installed and understand what information is shared with their family group. Using KinStatus to conceal monitoring from the person being monitored is a violation of these Terms.
6. Check-ins, notifications, and location
- Check-ins: the protected person responds to scheduled check-ins ("I'm OK", "Call me", "I need help"); caregivers can view and respond to these check-ins according to their role.
- Notifications: KinStatus sends reminders and alerts to caregivers and to the protected person, using push notifications. We cannot guarantee that any notification is delivered, seen, or acted on.
- Location: location sharing is optional and is controlled by the protected person through their phone's Android Settings and the system location permission. There is no separate in-app location toggle. Once that permission is removed, KinStatus stops receiving new location data; see our Privacy Policy for full detail, including how a previously stored location value and a small on-device queue of already-captured readings are handled.
7. Android permissions
KinStatus's features depend on Android operating-system permissions granted on the protected person's phone (for example, location and notifications). You control these permissions through your phone's Settings at any time. Removing a permission may reduce or stop the corresponding KinStatus feature, as described in our Privacy Policy.
8. Service limitations
KinStatus is provided on an "as available" basis. Features, availability, and performance depend on your device, network connectivity, third-party services (including push-notification and mapping providers), and factors outside our control. We do not guarantee continuous, uninterrupted, or error-free operation of the service.
9. Acceptable use
You agree not to:
- use KinStatus for any unlawful purpose, or in a way that infringes another person's rights;
- attempt to access another user's account or data without authorisation;
- interfere with, disrupt, or attempt to circumvent the security or normal operation of KinStatus;
- reverse-engineer, decompile, or extract source code from the KinStatus app, except to the extent applicable law permits;
- use KinStatus to monitor anyone without the lawful basis and knowledge described in Section 5.
We may suspend or restrict access to protect the service, other users, or ourselves from misuse of these Terms.
10. Intellectual property
KinStatus, including its name, branding, app, and website content, is owned by us or our licensors and is protected by applicable intellectual property laws. These Terms do not transfer any ownership rights to you. You may use KinStatus only as permitted by these Terms.
11. Free trial, plans, and payment
11.1 Free trial
Eligible new families may receive a 30-day free trial. Eligibility is limited to prevent repeated use of the trial by the same family or device and depends on KinStatus being able to perform its supported eligibility check. The KinStatus trial is not an app-store promotional subscription trial: it requires no card or payment details and does not convert into a paid subscription by itself. Nothing is charged merely because the trial ends. If no trial is available, or after a trial ends, the family can use Free Basic or choose a paid plan.
11.2 Plans
The paid KinStatus plans are Plus and Family. The Pricing page describes their features and capacities. Website prices may be localised for your country; the final price, currency, billing period, taxes, and other purchase terms are the ones your app store shows before you confirm a purchase, and the store information prevails if it differs from the website.
Premium is planned for a later release and is not part of Plus or Family.
11.3 Free Basic
Free Basic is a limited mode available without a paid plan, subject to the capacities and features described on the Pricing page. Access to account management, support, legal information, and account deletion remains available. KinStatus does not require a paid plan merely to display or resolve an active distress status.
11.4 Purchase, renewal, and cancellation
Paid plans are purchased through the app store through which the subscription is offered, such as Google Play or, where available, the Apple App Store. The store processes the payment; KinStatus does not receive or store your card, bank, or billing details.
The billing period, price, and whether a subscription renews automatically are shown by the app store before purchase. Where a subscription renews automatically, renewal and cancellation follow the store's process and applicable mandatory law.
Where the subscription-management option is available in KinStatus, it opens the applicable store's subscription settings. You can also manage the subscription directly through the store through which it was purchased.
11.5 Subscription status, refunds, and payment problems
KinStatus uses the subscription status reported by the applicable app store to determine paid access. A cancellation may leave paid access available until the store-reported effective expiry date, while a refund, revocation, account hold, expiry, or other store-reported state may affect paid access earlier. If no effective paid entitlement remains, the family can use Free Basic.
Refunds, chargebacks, statutory remedies, and related payment decisions are subject to the applicable app-store process and mandatory consumer law. Nothing in these Terms limits rights that cannot lawfully be excluded.
11.6 Price changes
Changes to subscription prices follow the applicable app-store process and mandatory law. The store will provide whatever notice or confirmation its rules and applicable law require. The price shown by the store for the applicable transaction or renewal is authoritative.
11.7 Mandatory rights
Nothing in this Section 11 removes or limits cancellation, withdrawal, refund, conformity, digital-service, or other consumer rights that applicable mandatory law gives you.
12. Suspension and termination
We may suspend or terminate your access to KinStatus if you materially breach these Terms, including the acceptable-use rules in Section 9, or if we reasonably believe doing so is necessary to protect the service, other users, or ourselves. You may stop using KinStatus, or delete your account, at any time — see our Delete Account page. Where paid access ends and the account remains open, the family may continue on Free Basic subject to the limits described on the Pricing page.
13. Account and data deletion
You can request deletion of your account and data as described in our Delete Account page and our Privacy Policy. Some information may be retained after deletion where the law requires or justifies it, or where it is needed to protect other family members' access, as explained in those pages.
14. Third-party services
KinStatus relies on third-party services to operate, including Supabase (database, authentication, and server functions), Expo and Google Firebase Cloud Messaging (push notifications), Google Maps (map display), SuperHosting.BG EOOD (website and mailbox hosting), and the applicable app store. Google Play and, where applicable, the Apple App Store provide distribution, subscription-management, and payment services under their own terms. KinStatus depends on information returned by the applicable store to validate purchases and determine subscription status. Your use of these integrated services is also subject to their own terms, where applicable. We are not responsible for the availability or performance of third-party services outside our control.
15. Disclaimers and liability
KinStatus is provided in good faith to help families stay in touch, but it is not a substitute for direct contact, professional care, or emergency services. To the fullest extent permitted by applicable law, we are not liable for indirect or consequential loss arising from your use of KinStatus, or from a delayed, inaccurate, incomplete, or undelivered check-in, location update, reminder, or alert.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including mandatory consumer-protection rights available to you under Bulgarian and EU law. If you are a consumer, these Terms do not affect your statutory rights.
16. Governing law
These Terms are governed by the law of the Republic of Bulgaria, without prejudice to any mandatory consumer-protection provisions of the law of the country in which you are habitually resident, where applicable. Any dispute will be subject to the jurisdiction of the competent Bulgarian courts, without prejudice to any right you have to bring proceedings in your own country of residence under applicable consumer-protection law.
17. Changes to these Terms
We may update these Terms as KinStatus develops, and we will change the "Last updated" date above when we do. Where applicable law requires advance notice of a change, or your acceptance of it, we will provide that notice, or seek that acceptance, through an appropriate channel before the change takes effect.
